It was the rule at common law and under the English statutes that estates of remainder or reversion could not be divided by proceedings for compulsory partition. Having now learned how people split ownership temporally, serially serving as owners, we will study the means by which people can own the same thing at the same time. Instead of “O to A and then to B,” let’s consider “O to A and B.”.

Partition Actions in Condominium Projects (a) Except as provided in this section, the common area in a condominium project shall remain undivided, and there shall be no judicial partition thereof. Nothing in this section shall be deemed to prohibit partition of a cotenancy in a condominium.   The Co-tenancy Modernization and Majority Protection Act which passed the West Virginia Legislature took effect June 3, It made big changes in oil and gas leasing and surface owners’ rights. Most importantly, if the driller is using the co-tenancy statute to drill a well, then the well pad and roads, etc. needed to drill that well cannot be placed on a surface owner’s land.

Partition by original cotenancies--Further partition or cotenancy. Partition according to respective rights of parties--Surveys and landmarks. Road or street set aside before partition or sale. cotenancy: n. the situation when more than one person has an interest in real property at the same time, which may include tenancy in common, joint tenancy or tenancy by the entirety. (See: cotenant, tenancy in common, joint tenancy, tenancy by the entirety, community property).

In property law, a concurrent estate or co-tenancy is any of various ways in which property is owned by more than one person at a time. If more than one person owns the same property, they are commonly referred to as co-owners. Legal terminology for co-owners of real estate is either co-tenants or joint tenants, with the latter phrase signifying a right of survivorship.

Define cotenancy. cotenancy synonyms, cotenancy pronunciation, cotenancy translation, English dictionary definition of cotenancy.

cotenant: n. one who holds an interest in real property together with one or more others. (See: cotenancy). A co-tenancy clause in retail lease contracts allows tenants to reduce their rent if key tenants or a certain number of tenants leave the retail space.

A large or key tenant is a big draw for. cotenancy. A form of property ownership in which two or more persons or entities own undivided interests do not always have to be in equal shares. Few married couples, when opening a joint bank account, appreciate the subtle differences between the possible forms of ownership in which they may hold an account or, much less, the potentially significant consequences that flow from the form they select.

For instance, they probably do not realize that the selected form will determine whether their account may be subject to the individual. In addition, before any Tenant may seek partition of the Property, that Tenant must first provide the right of first offer described in Paragraph 3(a) hereof, and must include in the required written notice that he intends to seek partition if his interest is not purchased by.

However, attributes of the cotenancy or a profile of the cotenants may provide evidence that a partition action will exceed typical costs. The case studies cited in this article suggest that cotenant profiles could be the most critical factor in evaluating partitioning potential and costs.

In other cases (cotenancy partition and airplane overflights), the book criticizes legal institutions for creating too much property when in fact existing law already scales property’s exclusivity to its tendency to encourage the free and concurrent use of the propertized asset.

Now days drillers generally try to use the “cotenancy” statute before/instead of trying to use partition suits. If there are seven or more co-owners, and if the driller can get co-owners that own get 75% of the interest in a mineral tract to sign leases (and maybe amendments, but maybe not), then the driller can drill.

The Court of Appeals had to determine how much deference the referees’ report was owed. In previous decisions, the state supreme court had cited a Freeman treatise on Cotenancy and Partition from Freeman’s book laid out the history of partition suits and use of : Paul Goeringer.
